ExchangeHomes.com reserves the right to cancel any Membership for any reason, including misuse of the site, any action we feel compromises the security of the site, any action that adversely affects other Members or their property, or any action we feel is detrimental to ExchangeHomes.com. If any information provided by a member is found to be grossly misrepresented, or should the member's listing(s) or actions be in violation of any law or any provision of this agreement, ExchangeHomes.com reserves the right to remove, at its discretion,
the members' listing(s) at any time, and/or to terminate the member's access to the web site, without refund. ExchangeHomes.com may also terminate any listing or membership at any time for any other reason or for no reason at all at ExchangeHomes.com's sole discretion, in which case the member will be entitled only to a pro rata refund of any fee paid.
We reserve the right to remove and ban as a Member, anyone who joins and sends out "spam" or "pirating" emails to other Members. Due to a number of past instances of spamming and pirating of our listings, it has been necessary to safeguard our paid memberships by scanning all outgoing emails for "trigger words" referencing other clubs or home exchange organizations—example: clubname.com. Senders of flagged emails are informed that their email(s) have been blocked and are invited to remove the flagged content and resubmit. Programming will automatically remove the memberships of repeat "spammers".
Similarly, anyone who enters falsified personal information to join will be removed. This web site places heavy emphasis upon member privacy and anyone entering falsified personal information will be viewed as an attempted threat to that privacy.
This web site is a service of a "for fee" membership organization, and all information contained herein is unconditionally private and not in the public domain. This information is not sold or distributed publicly. No part of this online database may be reproduced, stored in a retrieval system, transmitted in any form or in any language, by any means, electronic, mechanical, photocopied, recorded or otherwise. Unauthorized use of this site will result in immediate cancellation of membership with all fees being forfeited. Violators will also be fully exposed and confronted to the fullest degree of all applicable laws, both national and international.
So that our commitment to the highest level of Member Security is never compromised, once you have joined our home exchange organization and verified your intentions by payment of a Membership Fee, no refunds can be authorized. As a paid Member, you gain immediate unrestricted contact with fellow Members. Should circumstances arise where a paid Member unexpectedly needs to discontinue their Membership, we will be more than happy to assist them by crediting their account with all unused days, these to be held indefinitely until the Member is able to resume their Membership.
ExchangeHomes.com reserves the right, at its discretion, to amend and edit copy entered into the ExchangeHomes.com online database by members. All copy edits submitted by members are subject to review and approval of ExchangeHomes.com.
For content that is covered by intellectual property rights, such as photographs, images and descriptive text (IP content), members specifically give us the following permission, subject to their privacy and application settings:
You grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with ExchangeHomes.com (IP License). This IP License ends when you delete your IP content or your account.
When ExchangeHomes.com members add photographs/pictures/images/passages of text to their publicly viewed listings, we assume they hold all necessary intellectual property rights to that material. We will immediately remove any content or information members post on ExchangeHomes.com
if we believe that it infringes or violates this Statement, but we rely wholy upon our members' integrity in posting and assume absolutely no reliablity or responsibility for material they choose to upload to their listings.
Notwithstanding its right to edit and amend copy and photographs, ExchangeHomes.com accepts and holds no liability for any loss or damage resulting from the design or positioning of the properties or changes made to the photographs and copy submitted by the member
or edited by ExchangeHomes.com staff.
All listings on ExchangeHomes.com, as submitted by the member and amended from time to time by ExchangeHomes.com staff, are the responsibility of the member, and ExchangeHomes.com specifically disclaims any and all liability arising from the alleged accuracy of the listings, or any alleged breaches of contract on a member's part. By accepting these Terms and Conditions and paying to list on ExchangeHomes.com, you agree to indemnify and hold ExchangeHomes.com harmless against all costs, expenses and losses arising out of a claim relating to the content of a listing.
ExchangeHomes.Com is a HOME EXCHANGE organization. All properties listed with us must offer Home Exchange as the primary alternative. However, we do understand that many members do use a second or vacation home as their exchange property and provided that home exchange is their first alternative, they can list rental as a second option. Specific reference to rental charges etc., are not allowed. This information can be conveyed to interested parties after they initiate inquiries. Any listing that is reported to be soliciting for rental will be removed and no fees refunded.
Don't place links to rental web sites or web pages itemizing rental charges in your listing. They will be removed.
You will be requested to choose a Password to access the "Members only" area of the website and the email associated with your membership will become your Username. You will be required to use your Password and Username each time you log on to the ExchangeHomes.com website.
You must comply with all directions issued by ExchangeHomes.com pertaining to use of your Password or Username and you must never disclose your Password or Username to any other person. ExchangeHomes.com holds you responsible for keeping your login information strictly confidential.
ExchangeHomes.com cannot warrant that your access to, or use of the ExchangeHomes website will be continuous or uninterrupted. The website may not be available from occasionally due to upgrades or maintenance being carried out. You acknowledge that disruptions to the operation of the website may also occur which are outside ExchangeHome's control and which may occasionally affect your access to or use of the website.
One of the most critical parts of home exchanging is understanding that once you make a firm commitment, people miles away are counting upon you to honor that arrangement. If they have committed themselves to actually purchasing tickets, then their financial outlay has been considerable and once that point has been reached, it would be reprehensible for you to cancel.
If we ever hear of a member canceling an exchange once a firm commitment has been made and tickets have been purchased, that member will be blacklisted and barred from future membership with ExchangeHomes.com and the member will be reported to CHECtravel for circulation.
At ExchangeHomes.com we value our members. You are what make us successful and we know we have an obligation to you, not only to provide the highest quality service, but to never breach the trust you place in us.
Currently, to better serve our members with many more home exchange opportunities in Europe, ExchangeHomes.com has arranged an affiliation with Echangeimmo.com, a leading French home exchange organization. Echangeimmo has an English language portal—HomeForSwaps.com—serving exchangers throughout the UK; both web sites are fed from one database.
Echangeimmo / HomeForSwaps enforces a privacy policy very similar to our own and just like ExchangeHomes.com, is a member of CHECtravel, the organization that has created and maintains professional standards for home exchange agencies, as well as a code of conduct for individual exchangers. All CHECtravel member clubs have been assessed and approved by an independent committee consisting of club owners, industry professionals and experienced home exchangers.
Outside of our affiliation with Echangimmo, ExchangeHomes.com never has and never will, sell or give away personal information to other organizations. ExchangeHomes.com does not reveal your name, street address, phone number, or email address in your listing, or make them available over the World Wide Web. Our sophisticated programming hides your personal contact information yet makes it possible for fellow members to contact you directly from your listing 24/7. Any personal information you provide is for our records only.
We believe that organizations that partake in selling your personal Information are behaving unethically, and are invading your privacy! We encourage you to ask organizations about their own privacy policies, and what they intend to do with the information they collect from you.
